Terms and Conditions for PM Micro Tutoring Services

By checking this box, you (the “Guardian”) agree to the following terms and conditions for micro tutoring services provided by Practicing Musician and its affiliated teachers (the “Teacher”) for the benefit of your child (the “Student”):

  1. Services: The Teacher will provide micro tutoring lessons in accordance with Practicing Musician’s services.
  2. Teacher Vetting and Training: All Teachers undergo a rigorous vetting process, including:
    a) Initial screening of qualifications and experience
    b) Completion of a one-week intensive training program covering Practicing Musician’s tutoring methodology, platform usage, best practices for online instruction, and student engagement techniques
    c) Passing a comprehensive background check before approval to tutor on the platform
  3. Scheduling: You will schedule your lesson for a recurring day and time each week for the duration of your subscription. Changes to dates and times require mutual agreement between the Teacher and Guardian.
  4. Cancellation and Rescheduling: A 24-hour notice is required for rescheduling or cancelling sessions. Failure to provide adequate notice may result in forfeiture of the lesson.
  5. Fees: The fee per lesson is as stated during the checkout process. This agreement relates to the block booking of lessons selected during checkout, payable in full and in advance.
  6. Term and Automatic Renewal: This agreement continues until terminated and will renew automatically at the beginning of each recurring payment period unless cancelled by the Student/Guardian.
  7. Termination: Either party may terminate this agreement with written notice as specified in the cancellation policy.
  8. Rate Changes: The Teacher may review and increase rates with appropriate written notice.
  9. Refund Policy: a) Full refunds are available within 14 days of purchase only if no lessons have been taken. b) No refunds will be provided after the first lesson in the subscription has been delivered.
  10. Attendance: The Guardian is responsible for ensuring the Student’s availability for arranged online lessons. Missed lessons without proper notice remain payable.
  11. Make-up Lessons: If a Teacher misses a lesson, a replacement will be provided at an agreed time.
  12. Additional Lessons: Extra lessons may be scheduled by purchasing additional micro tutoring sessions.
  13. Copyright: The Guardian and Student agree not to make unlawful copies of music materials.
  14. Health Information: The Guardian is responsible for informing the Teacher of any relevant medical or health conditions.
  15. Compliance: Both parties agree to comply with all applicable laws and regulations, including those related to privacy and data protection (e.g., FERPA, COPPA, GDPR).
  16. Force Majeure: Neither party shall be liable for breaches caused by events beyond reasonable control.
  17. Technology and Equipment: The Guardian is responsible for providing suitable space and technology for online learning. The Teacher is not responsible for loaning equipment or resolving technical issues.
  18. Intellectual Property: Materials supplied electronically remain the property of Practicing Musician.
  19. Lesson Recordings: Lessons will be recorded for quality assurance and liability purposes. Recordings must not be shared or uploaded to social media. These recordings are securely stored and may be reviewed in case of disputes or for training purposes. By using our service, both Teachers and Students/Guardians consent to this recording policy.
  20. Communication: All lesson-related communications must be between the Guardian and Teacher via email.
  21. Conduct: Inappropriate behavior or material may result in immediate termination of the lesson and potentially the agreement.
  22. Dress Code: Both Teacher and Student must dress appropriately for lessons and maintain a neat, professional background.
  23. Safeguarding: The Teacher agrees to comply with Practicing Musician’s safeguarding policies.
  24. Independent Contractor Status: Teachers providing micro tutoring services through Practicing Musician are independent contractors, not employees. They set their own schedules, use their own equipment, and are responsible for their own taxes and benefits. Practicing Musician provides the platform to connect teachers with students, but teachers operate independently in delivering tutoring services.
  25. Changes in Teacher or Instrument: Students/Guardians may request a change of Teacher or instrument at any time during their subscription period:
    a) To request a change, contact Practicing Musician’s customer support via email or through the platform.
    b) Every effort will be made to accommodate such requests, subject to Teacher availability and scheduling constraints.
    c) Changes in Teacher or instrument will not affect the existing subscription term or payment schedule.
    d) If a suitable alternative cannot be found immediately, the Student/Guardian may choose to pause their subscription until an appropriate match is available.
    e) Practicing Musician reserves the right to reassign Teachers in case of unforeseen circumstances, ensuring continuity of service.

By checking this box, you acknowledge that you have read, understood, and agree to these terms and conditions. You authorize the Teacher to provide online tuition to the Student until termination of this agreement.

Note: While Teachers strive to ensure satisfactory progress, success depends on regular practice as advised.
