Please read this carefully. By signing it, you give up certain legal rights, including the right to sue for injuries caused by ordinary negligence.

1. Who this agreement is between

This agreement is between The Practicing Musician S.P.C., a Washington social purpose corporation (“Practicing Musician,” “we” or “us“), and the person who signs it (“you“). If you sign for a participant under 18, you sign as their parent or legal guardian. In that case, “you” means both you and the participant.

2. The program

Practicing Musician runs four-week beginner percussion classes (“Group Lessons“). Classes are held in person at partner organizations (each a “Host“), such as newLife Bainbridge Island and New Life Sandpoint. Each class meets once a week for about an hour with a trained facilitator.

Participants play snare drum and bell kit (glockenspiel), bring and set up their own equipment, and watch short video lessons online between classes.

3. Risks

Playing percussion in a group is generally low-risk, but it is not risk-free. The risks include:

• Strain or overuse injuries to the hands, wrists, arms, shoulders, neck or back from repeated motion or posture

• Effects on hearing from loud sound, since drums and bells can be loud with many players in one room [we recommend hearing protection]

• Tripping or falling over stands, cases, bags or other equipment

• Pinched fingers when setting up or folding stands and cases

• Injury from lifting, carrying or rolling equipment to and from class

• Accidental contact with sticks, mallets or other participants

• Conditions of the Host’s building, parking lot and grounds

• Illness passed between people sharing a room

• Travel to and from class

• Other risks that no one can foresee

4. Your responsibilities

You agree to:

• Follow the safety instructions of the facilitator and the Host

• Stop playing and tell the facilitator if you feel pain, dizziness or discomfort

• Decide for yourself whether you are healthy enough to take part, and ask a doctor if you are unsure

• Stay home if you are sick

• Treat other participants, facilitators and Host staff with respect

If you have a health condition that could affect your safety in class, we encourage you to tell the facilitator in person.

5. Participants under 18

• Participants must be at least [5] years old.

• A participant under [13] must have a parent, guardian, or an adult the parent chooses stay in the building for the whole class.

• For participants aged [13] to 17, the parent or guardian is responsible for them before class starts and after it ends, including drop-off and pick-up.

• Facilitators run the class. They do not provide childcare.

6. Your equipment and belongings

You are responsible for your own instruments and belongings. Practicing Musician and the Host are not responsible if they are lost, stolen or damaged.

If you rent or buy an instrument from Sweetwater Sound or anyone else, that arrangement is between you and that company, not Practicing Musician (see Section 24 of our Terms of Service).

7. Accepting the risks

You understand the risks described above and choose to take part anyway. You accept those risks, known and unknown, for yourself and, if you sign as parent or guardian, for the participant.

8. Release of claims

To the fullest extent the law allows, you release and agree not to sue Practicing Musician, the Host, and each of their officers, directors, employees, contractors, facilitators and volunteers (the “Released Parties”) for any injury, illness, loss or damage arising from taking part in Group Lessons. This includes claims based on the Released Parties’ own ordinary negligence. This release does not cover gross negligence, recklessness or intentional misconduct.

9. Covering our costs

If you, or anyone acting for the participant, brings a claim that this agreement releases, you agree to pay the Released Parties’ reasonable costs of defending it, including attorney fees.

10. Emergency medical care

If the participant is hurt or becomes ill during class, you authorize the facilitator or Host staff to call 911. If neither you nor the emergency contact can be reached right away, you also authorize them to get emergency medical care for the participant.

You are responsible for the cost of that care. Facilitators are not medical professionals [and may not be trained in first aid].

11. Behavior and removal

We may remove anyone whose behavior is unsafe or disruptive, or who does not follow this agreement. The Refund and Cancellation Policy explains what happens to your payment if that happens.

12. Photos and recordings

Whether Practicing Musician and the Host may use photos or video of the participant is your choice, made separately in the Media Release. Please do not record or post photos or video of other participants or the facilitator without their permission.

13. How this fits with our other policies

Your use of the Practicing Musician online platform is covered by our Terms of Service and Privacy Policy. Fees and refunds are covered by the Group Lesson Refund and Cancellation Policy. For in-person classes, this agreement controls if it conflicts with the Terms of Service.

14. Which law applies

Washington law governs this agreement, and disputes will be handled in the state or federal courts in King County, Washington, as in Section 29 of our Terms of Service.

15. If part of this agreement is unenforceable

If a court finds any part of this agreement unenforceable, that part will be enforced as far as the law allows, and the rest of the agreement still applies.

16. How long this agreement lasts

This agreement covers the session you register for and any later Group Lessons the participant attends, unless we ask you to sign a newer version.

17. Signature

By checking the box and typing your name, you confirm that:

• You have read this agreement and understand it

• You understand you are giving up legal rights

• You are at least 18 years old

• If the participant is under 18, you are their parent or legal guardian
